The NJDEP waiver rule, which took effect August 1st, allows the DEP Commissioner to grant exemptions to certain environmental regulations enforced by NJDEP. The occasions where the waiver could be implemented are: if there is a conflicting policy with other rules or regulations at the state or federal level; if the rule would result in hardship or excessive costs and a safe alternative is available; protection of the natural resource or environment is preserved; or if there is a state or federal public emergency. According to NJDEP, the rule is intended to reduce the red-tape and gridlock that often occurs in the development process. Although this rule may provide relief in certain cases, NJDEP notes that it is not intended as an override to its regulations. On July 25, 2012, a case was filed by the Columbia Environmental Law Clinic on behalf of 27 environmental and labor organizations, including the Sierra Club, the New Jersey Highlands Coalition, the Teamsters, United Steelworkers and Rutgers Administrators Union, charging that the NJDEP was ignoring statutes by offering waiver considerations on a case by case basis.
